On May 8, the Delhi High Court rendered a verdict on a public interest litigation (PIL) brought forth by a petitioner, aiming to secure directives for facilitating Chief Minister Arvind Kejriwal’s governance of the Delhi administration while in Tihar jail. The court, presided over by a division bench comprising Acting Chief Justice Manmohan and Justice Manmeet Pritam Singh Arora, not only dismissed the PIL but also levied a fine of ₹1 lakh against the petitioner.

The court’s decision was grounded in the critique that the petitioner had overstepped the bounds of the court’s jurisdiction by advocating for measures to silence political adversaries. Specifically, the petitioner’s plea for restrictions on the activities of Delhi BJP President Virendra Sachdeva, intended to curtail any perceived coercion on Kejriwal to step down from his position, was met with disapproval from the bench.

In dismissing the PIL, the court underscored the importance of respecting the delineation of powers and the autonomy of political actors within the democratic framework. By rejecting the petitioner’s demands, the court reaffirmed its commitment to upholding the principles of democratic governance and the rule of law.

The imposition of a fine further underscored the court’s stance on the frivolous nature of the petition and served as a deterrent against similar attempts to misuse the judicial process for political ends. This punitive measure aimed to discourage litigants from pursuing baseless or politically motivated PILs, thereby safeguarding the integrity of the legal system and preserving its role as a bastion of justice.

Overall, the Delhi High Court’s ruling represented a robust defense of democratic norms and institutional integrity, reaffirming the judiciary’s role as an impartial arbiter and guardian of the constitution.
